• You may redeem 400 loyalty points to receive $20 off any purchase of $20 or more before taxes at bodyenergyclub.com

• You may redeem 1000 loyalty points to receive $75 off any purchase of $75 or more before taxes at bodyenergyclub.com

LOYALTY POINTS PROGRAM – ONLINE AND IN-STORE

Welcome to Body Energy Club’s retail store loyalty points program. All Body Energy Club members with an account at our retail stores are automatically enrolled in our loyalty points program. The more you spend at Body Energy Club retail stores, the more loyalty points you will accumulate through our loyalty points program!

Please note that this loyalty points program applies only to purchases made at Body Energy Club’s retail stores in British Columbia, Canada. Exclusions and terms and conditions apply.

TERMS AND CONDITIONS:

1. For every full Canadian dollar that you spend at a Body Energy Club retail store (using cash, credit or debit card, or gift cards), you will earn one (1) loyalty point; however, there are a number of exceptions to this:
   • You will not earn any loyalty points for purchases of discounted items.
2. You will not earn any loyalty points for purchasing gift cards.

3. You will not earn any loyalty points for purchases made on our website or through our smartphone application. (There are different loyalty programs for these purchases.)

4. You will not earn any loyalty points for purchases of smoothies, bowls, and juices. (There are different loyalty programs for these items.)

5. You will not earn any loyalty points for any applicable taxes, tips, or donations.

6. You will not earn any loyalty points when you pay for your purchases with redeemed loyalty points.

7. We may, from time to time and in our sole discretion, exclude certain products from our loyalty points program. This includes both for earning loyalty points and for redeeming loyalty points.

8. In no event will we issue you any fractional loyalty points. In order to receive a loyalty point, you must spend a full Canadian dollar and purchase a product to which no exclusions apply.

9. You may redeem your loyalty points as follows:

   • You may redeem 400 loyalty points to receive $20 off any purchase of $20 or more before taxes at a Body Energy Club retail store.

   • You may redeem 1000 loyalty points to receive $75 off any purchase of $75 or more before taxes at a Body Energy Club retail store.

10. If you wish to redeem your loyalty points or any coupon on your account, then we may ask you for government-issued photo identification for the protection of your account and to confirm your identity.

11. Our loyalty point program is only available at our retail stores in British Columbia, Canada. Our retail stores in the United States of America are excluded from this program.

12. Your points will never expire as long as you shop with us at least once a year to keep your account active.

13. Our loyalty points program is intended for personal use only. Our loyalty points program is not intended for commercial use.

14. Your Body Energy Club account is personal to you. Similarly, your loyalty points are personal to you, and may not be sold, transferred, or shared with any other person.

15. Our loyalty points have no cash value.

16. Unfortunately, you cannot use your loyalty points to make purchases on our website or through our smartphone application.

17. We are not liable or responsible in any way for any tax consequences which may flow from your participation in our loyalty points program. You will be solely responsible for your own tax payments and reporting requirements (including, without limitation, any income tax reporting requirements).

18. When setting up your Body Energy Club membership we require a first name, last name, 10 digit code (phone numbers are commonly used for simplicity but not required), birthday and month, valid email address and government issued photo identification to confirm your identity and protect you from fraudulent activity.

19. We reserve the right to suspend or terminate your membership in our loyalty points program if we suspect that you are abusing our loyalty points program or if we suspect you are in breach of these terms and conditions.

20. We reserve the right to amend these terms and conditions or terminate our loyalty points program at any time and for any reason. In such an event, you will have no recourse against us. Any amendments to these terms and conditions will be effective immediately upon posting the revised terms and conditions to our website (www.bodyenergyclub.com) and you waive any right you may have to receive notice of such amendment(s).

21. If any provision or part of a provision of these terms and conditions are deemed to be unlawful or unenforceable, that provision or part of the provision is deemed to be severable from these terms and conditions and does not affect the validity and enforceability of any of the remaining terms and conditions.

22. Our loyalty points program is governed by the laws of the Province of British Columbia, Canada.

23. Sorry, there are no exceptions to any of the foregoing terms and conditions.
